1) Acceptance of Terms

By accessing or using gmwforms.com (the “Service”), you agree to be bound by these Terms of Use (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2) Eligibility; Use by Minors (Ages 13–17)

7) Content Standards & Moderation

We may (but are not obligated to) review, moderate, refuse, or remove User Submissions at our discretion, including to protect minors, enforce these Terms, or comply with law. We may preserve and disclose information if required by law or in good faith to protect users or the Service.

8) Intellectual Property

The Service and all materials provided by [Company] (excluding User Submissions) are owned by [Company] or its licensors and protected by IP laws. Except as expressly allowed, you may not use, copy, or create derivative works from the Service content.

We are not responsible for third-party services, content, or policies. Your use of third-party offerings is at your own risk and subject to their terms.

11) Changes to the Service or Terms

We may modify the Service and these Terms at any time. Material changes will be posted with an updated Effective Date. Continued use after changes constitutes acceptance.

12) Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.

13) Limitation of Liability

To the fullest extent permitted by law, GMW Systems LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or revenues, arising from or related to your use of the Service, even if advised of the possibility. Our total liability shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100.

14) Indemnification

You agree to defend, indemnify, and hold harmless GMW Systems LLC and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your User Submissions, or your breach of these Terms.

15) Termination

We may suspend or terminate access to the Service at any time, with or without notice, including for violations of these Terms or risk to minors. Upon termination, sections intended to survive (e.g., licenses granted, disclaimers, limitations of liability) will continue.

16) Governing Law; Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Washington state, without regard to conflict-of-laws principles.
  • Arbitration: Any dispute shall be resolved by binding arbitration in Everett, Washington. Class actions and jury trials are waived.
  • Consumers / Minors: To the extent required by law, arbitration or class action waivers may not apply to certain consumers or minors. Parents/guardians, as applicable, consent to dispute resolution terms on behalf of minors where permitted by law.

17) Regional Terms (If Applicable)

If you operate in specific regions, include addenda such as:

  • United States (COPPA): We do not knowingly collect personal information from children under 13. Parents can contact us to review, delete, or stop further collection.
